MAY 3 2013: Some DACA (deferred action) cases are being set for interviews at local USCIS offices. If you receive an interview notice, call or text 703.964.0245.
CONSIDERATION OF DEFERRED ACTION FOR CHILDHOOD ARRIVALS (DACA)
Though it's not quite the DREAM Act, the new "Consideration of Deferred Action for Childhood Arrivals" program (DACA) will help a lot of young people.
It is not a risk-free process. You need to make sure it works for you. You can only tell if you talk to an expert who takes the time to understand your situation, ask you the right questions, and makes a recommendation for you.
DACA will be very helpful for most people. So you should definitely find out if you qualify, and if so, the next step is to make sure there are no hidden risks for you.
Once you've consulted with an expert and you decide to apply, you need to make your case as strong as possible. There are things USCIS requires, and other things it recommends. Every case is different: if you think you can just follow the instructions and fill out the forms, you are making what may be a very big mistake. You get ONE chance to do it right. Unlike other immigration applications, if you are denied, there is no appeal. The first decision you get is the final one.
The process includes an application for deferred action, (Form I-821D) a work permit application (Form I-765), and a work permit worksheet (Form I-765WS). Total government fees: $465. Once you are granted deferred action and obtain your work permit, you can apply for your own social security number. Click here to learn how.
We are preparing and filing dozens of DACA cases. We've seen a lot of issues come up. Here are some things to watch out for:
Please beware of "notarios" or other non-lawyer "immigration consultants." Only talk to an immigration lawyer. Do not file anything with the government without talking to an immigration lawyer. Click here to learn more.
